Attorney General Chikosa Silungwe has written Malawi Electoral Commission to suspend its operations, a day after President Lazarus Chakwera fired two commissioners Linda Kunje and Jean Mathanga.
According to Silungwe, the firing of Kunje and Mathanga means there is no electoral body in the country. This is because the country`s constitution stipulates in 75(1) that the body should have not less than six commissioners for it to operate.
In an interview with a local radio station, Malawi Law Society President Patrick Mpaka, has backed government`s legal advisor.
Chakwera has fired the two commissioners after the Supreme Court of Appeal found them incompetent, in relation to management of last year`s nullified elections.
Section 75(4) of Malawi`s constitution, gives the president power to fire commissioners dimmed incompetent by Parliament.
